What’s involved in creating a Will?
Planning for your estate in the event of your passing can be a difficult conversation at any stage. However, the truth is that having no plan in place is much more difficult for your friends and family.
We help you consider all aspects of your life right now, as well as consider future scenarios, so we can create a Will that gives you peace of mind moving forward. We cover key documents such as:
Will & Testament: A will and testament is a legal document that outlines how a person's assets will be distributed after they die. It's basically a way for someone to ensure that their wishes are carried out and that their estate is passed on to the people they want to receive it.
Power of Attorney Document: A Power of Attorney document is a legal document that allows someone to give another person the authority to act on their behalf. The person who grants the power is called the principal, and the person who is given the authority to act is called the attorney-in-fact or agent.
The Power of Attorney document can be used in a variety of situations, such as when the principal is unable to make decisions due to illness or incapacity, or when the principal is out of the country and needs someone to act on their behalf.
Enduring Guardianship: Enduring Guardianship is a legal arrangement that allows someone to appoint a trusted person, known as an enduring guardian, to make decisions about their personal and medical care if they become unable to make decisions for themselves due to illness or incapacity.
The enduring guardian is authorized to make decisions on behalf of the person, called the principal, about things like medical treatment, where the principal lives, and other personal matters. The guardian is expected to make decisions that are in the best interests of the principal and to act in accordance with their wishes as much as possible.
Your Will should also be a ‘living’ document, one that we reassess at regular intervals so it is always as current as possible at any given time, accurately reflecting the state of your affairs as they stand today.
